1. Acceptance of These Terms
By accessing or using MomentEcho, you agree to be bound by these Terms.
2. Description of MomentEcho
MomentEcho provides selected quotes and AI-generated Readings based on those quotes and, when provided, optional context from the user.
A Reading is an automatically generated interpretation or perspective. It is intended to provide a response or point of view, not a guaranteed factual answer or professional recommendation.
MomentEcho may also allow users to save Readings and purchase Credits used for certain features.
3. Eligibility
You must be able to form a legally binding agreement under applicable law to use MomentEcho.
Where local law requires permission from a parent or guardian, you must obtain that permission before using the App.
4. Use of the App
Subject to these Terms, MomentEcho grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
You may not:
- use the App for unlawful purposes;
- disrupt, interfere with, or impair the App or related systems;
- attempt unauthorized access to the App, accounts, systems, or networks;
- copy, modify, reverse engineer, or derive source code from the App, except where applicable law expressly permits it; or
- submit or use harmful, infringing, abusive, or illegal content.
5. AI-Generated Content
MomentEcho may generate Readings automatically using AI based on a selected quote and optional context provided by the user.
AI-generated content may be incomplete, inaccurate, inappropriate, overly broad, or unsuitable in some circumstances.
It should not be treated as:
- a guaranteed factual statement;
- professional judgment;
- medical or mental-health advice;
- legal or financial advice; or
- emergency guidance.
You remain responsible for how you interpret and use the content.
6. Credits and Purchases
Certain MomentEcho features require consumable Credits.
Credits may be purchased through Apple’s in-app purchase system. One successful interpretation request currently uses one Credit unless otherwise shown in the App. A request that fails without returning a valid Reading should not use a Credit.
Credit packages and prices may change. Credits have no cash value and are non-transferable. Apple handles purchase and payment processing. Refund requests are subject to Apple’s policies and applicable law.
7. Saved Content
Saved Readings are stored locally on your device in the current version of MomentEcho.
Saved content may no longer be available after deletion, App removal, device loss, or device change. MomentEcho does not currently promise cloud sync, backup, or cross-device recovery.
8. Intellectual Property
MomentEcho owns or licenses the rights in the App, its software, branding, design, interfaces, and proprietary materials, subject to third-party rights in quotes and other licensed or public-domain content.
These Terms do not transfer ownership of the App or its proprietary materials to you.
9. Disclaimers
To the fullest extent permitted by applicable law, MomentEcho is provided “as is” and “as available.” We do not guarantee uninterrupted availability, error-free operation, or the accuracy, completeness, or suitability of AI-generated content.
Nothing in these Terms excludes rights or protections that cannot lawfully be excluded.
10. Limitation of Liability
To the fullest extent permitted by applicable law, MomentEcho and those involved in providing the App will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of, or inability to use, the App.
This limitation applies only to the extent permitted by law and does not exclude liability or consumer rights that cannot lawfully be limited or excluded.
11. Termination
MomentEcho may restrict or terminate access where these Terms are violated or where continued access creates legal, security, or safety risks. You may stop using the App at any time.
Provisions that by their nature should continue—including intellectual property, disclaimers, limitations of liability, and governing-law provisions—survive termination.
12. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we will update the Effective Date and publish the revised Terms. Your continued use after updated Terms take effect may constitute acceptance where permitted by applicable law.
13. Governing Law
These Terms are governed by applicable law.
Mandatory consumer protections in your place of residence are not excluded where applicable.
